License Agreement

By downloading, installing, copying or otherwise using the software product, you agree to be bound by the terms of this license. If you do not agree to the terms of this license, do no install, copy or use the software product.

The Software Product is owned by Power Electronics NZ or its suppliers and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. THE SOFTWARE PRODUCT IS LENT, NOT SOLD.

1. GRANT OF LICENSE.

Provided that  you comply with the terms and conditions of this License, POWER ELECTRONICS NZ grants to you the following rights under this License a non-exclusive, non-perpetual license to use the Software Product solely for use with POWER ELECTRONICS NZ products.

2. INTELLECTUAL PROPERTY RIGHTS.

All ownership, title and intellectual property right in and to the Software Product (including but not limited to any images, photographs, animations, video, audio, music, text and "applets" incorporated into the Software Product), and any copies you are permitted to make herein are owned by POWER ELECTRONICS NZ or its suppliers.

3. DISCLAIMER OF WARRANTIES.

The Software Product(s) is being provided "AS IS AND WITH ALL FAULTS" and without warranty of any kind. You expressly acknowledge and agree that the use of the Software Product(s) is at Your sole risk.

4. LIMITATION OF LIABILITY AND REMEDIES.

Under no circumstances, including negligence, shall POWER ELECTRONICS NZ, its affiliates or their directors, officers, employees or agents, be liable for any direct, indirect, incidental, special or consequential damages (including damages for loss of business products, business interruption, loss of business information and the like) arising out of the use or inability to use the software products(s), even if POWER ELECTRONICS NZ or its authorised representative has been advised of the possibility of such damages.
